Could you land a £2,500 fine and your van be held to ransom over this new MOT change? Well, new guidelines mean that while a fine is certainly possible, your vehicle legally cannot be ‘held to ransom.’

In the past, drivers could drive away if their vehicle failed it’s MOT to get any problems fixed elsewhere. However, with the new guidelines, that were introduced in May, certain motorists are unable to drive away if there is an issue/defect found with the vehicle.

And now, reports are coming in of drivers finding themselves being ‘held to ransom’ by mechanics who know this. And, are being charged inflated costs to get their vehicles back on the road.

Within the new guidelines, faults are rated by three categories. This includes minor, major and dangerous. Vehicles with minor defects will be able to pass their MOT and the issues will be recorded by the mechanic. However, if the faults fall into either the major or dangerous categories, then the vehicle will fail the MOT and consequently cannot be driven away.

And, consequently, if an owner drives their vehicle away, they could face a whopping fine and their insurance invalid.

But, despite all of this, an announcement has been made that mechanics cannot hold your van or prevent you from driving away. Regardless of how bad the vehicle has failed its MOT, mechanics have no power to stop the owner driving it away.

And, owners are under no obligation to get their vehicle fixed with the garage who did the MOT either. Instead, they are well within their rights to shop around and find the best deal for them. However, that doesn’t mean they can drive it away either. Oh no. But they can get it towed to another garage.

If they do decide to drive it though, this could cause a whole host of issues for the owner risking points, a potential ban and a stinking £2,500 fine!

A spokesperson described, “Garages are unable to prevent motorists from taking their car away.”

“Do your research before your MOT so that you can plan for a failure and what you will do.”

“Good research will find you a good garage that can advise you and look after you.”

“There are horror stories of motorists being stranded at MOT stations but your vehicle is your responsibility and not theirs.”

“A different repair garage can even collect your car for you and repair it, so it makes sense to shop around and not be held to ransom.”
